Understanding Visa Sponsorship in the US

By: Ugo Ugeh, Attorney at Law

When companies want to hire foreign workers in the United States, they must navigate the complex world of visa sponsorship. This comprehensive guide explains the different visa options and the sponsorship process.

What is Visa Sponsorship? Visa sponsorship is when a U.S. employer petitions on behalf of a foreign worker, essentially vouching for their eligibility to work in the United States. The employer takes responsibility for the worker's immigration status and compliance with visa requirements.

Common Visa Types H-1B Visa: For specialty occupations requiring a bachelor's degree or higher. Common in tech, finance, and professional fields. The employer must prove that no U.S. workers are available for the position.

L-1 Visa: For intra-company transfers of managers, executives, and specialized workers to U.S. offices. This requires the employee to have worked for the company abroad for at least one year.

EB-3 Visa: Employment-based immigrant visa for skilled and unskilled workers seeking permanent residence. This is a longer process but leads to a green card.

The Sponsorship Process The sponsorship process typically involves labor certification, petition filing, and approval. Each visa type has different requirements and timelines. For more information about visa options that may apply to your situation, contact our office for a consultation.
